Terms of Service.

These Terms govern your access to and use of the Galiaraa platform, operated by Soupler, registered in Faridabad, Haryana, India. By creating an account or using the platform, you agree to these Terms.

1. The Galiaraa Platform

Galiaraa is a travel discovery and planning platform. We are not a travel agency, tour operator, or booking agent. We provide a platform for creators to share travel videos and itineraries, for travelers to discover destinations, and for hotels and agencies to list properties and packages. Galiaraa is an intermediary under the Information Technology Act, 2000.

2. Eligibility and Account Responsibilities

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us at legal@galiaraa.com immediately if you suspect unauthorised access.

3. Account Types

All users register as a Traveler account. From app Settings you may upgrade to a Creator account or a Business account. See the Creator Agreement and Advertiser Terms for the terms specific to those account types.

4. Third-Party Relationships

Any transactions, bookings, or agreements you enter into with hotels, agencies, or other users discovered through Galiaraa are solely between you and that party. Galiaraa accepts no liability for refunds, cancellations, disputes, or service quality arising from those arrangements.

5. User Content

When you post content on Galiaraa, you grant us a non-exclusive, royalty-free, sublicensable, worldwide licence to display, distribute, and promote that content on the platform and in our marketing materials for as long as it remains published. You retain ownership. You are solely responsible for ensuring your content does not infringe third-party rights, violate applicable law, or breach our Community Guidelines.

6. Copyright Takedown Process

To submit a takedown notice under the Copyright Act, 1957 and IT Act, 2000:

• Email legal@galiaraa.com with subject "Copyright Takedown Notice"
• Include: your name and contact details, identification of the work, URL of the infringing content, a good-faith statement that the use is not authorised, and confirmation that the information is accurate
• We acknowledge within 24 hours and take appropriate action within 15 days

Counter-notice: Email legal@galiaraa.com with subject "Counter-Notice" within 10 days of removal if you believe the takedown was erroneous. Repeat infringers will be permanently terminated.

7. Acceptable Use

Prohibited conduct: automated scraping or data mining; reverse engineering; submitting fabricated itineraries; impersonating another user or business; using the platform to harass, threaten, or defraud; or violating our Community Guidelines.

8. Account Suspension and Termination

We may suspend or terminate accounts for violation of these Terms or Community Guidelines. Severe breaches (fraud, CSAM, criminal activity) result in immediate termination without notice. Terminated accounts may not re-register.

9. Indemnification

You agree to indemnify and hold harmless Galiaraa, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of: your use of the platform; your content; your violation of these Terms; or your violation of any third-party rights.

10. Limitation of Liability

Galiaraa provides the platform on an "as is" basis and makes no warranties regarding the accuracy of user-generated itineraries, the quality of listed properties, or the reliability of third-party services. To the maximum extent permitted by Indian law, Galiaraa's aggregate liability for any claim shall not exceed the amount paid by you to Galiaraa in the six months preceding the claim.

11. Force Majeure

Neither party shall be liable for any failure or delay resulting from events beyond reasonable control, including acts of God, natural disasters, war, government action, power failures, or internet infrastructure failures.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts at Faridabad, Haryana, with appeals to the Punjab and Haryana High Court at Chandigarh. Before initiating legal proceedings, you agree to attempt good-faith resolution with us at legal@galiaraa.com for 30 days.

13. Severability

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions continue in full force.

14. Changes to These Terms

We will notify registered users of material changes via in-app notification at least 15 days before they take effect. Continued use of the platform constitutes acceptance.

15. Plan This Trip — Lead Marketplace Subscription

The Plan This Trip feature allows verified Business accounts to subscribe to a monthly lead routing plan (Free, Base, Pro, or Exclusive tier). By subscribing, you acknowledge and agree to the following:

• No guarantee of lead quality or intent: Galiaraa matches and routes plan requests submitted by travelers to eligible businesses based on destination, preferences, and match score. We do not verify, screen, or guarantee the seriousness, intent, or financial readiness of any traveler submitting a plan request.
• No guarantee of conversion: Receiving a lead assignment does not guarantee a response, bid acceptance, or a confirmed booking. Conversion depends entirely on your offering, pricing, communication, and the traveler's ultimate decision. Galiaraa makes no representation that any lead will result in a booking or revenue.
• Subscription fees are for platform access only: Monthly subscription fees are charged for access to the lead routing engine and display placement — not for bookings or guaranteed outcomes. Fees are charged regardless of how many leads are received or converted.
• No refunds on unconverted or unresponded leads: Subscription fees are non-refundable once a billing cycle has commenced, irrespective of whether leads were received, responded to, or converted into bookings.
• Lead volume is not guaranteed: The monthly lead cap shown for each tier is the maximum you can receive — not a minimum. Actual lead volume depends on the number of traveler requests matching your destination and preference configuration in a given month.
• Subscription cancellation: You may cancel at any time. Your subscription remains active until the end of the current billing cycle. No partial refunds are issued for unused days.
